If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

All items purchased from TideandWeather.com, TopsailGiftBasket.com and TopsailTrading.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

The Gift Basket of Topsail Island Inc. and its affiliates attempt to be as accurate as possible. However, TideandWeather.com, TopsailGiftBasket.com and TopsailTrading.com does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by us itself is not as described, your sole remedy is to return it in unused condition.

These policies also govern your visit to our website. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

In-stock items will be shipped typically within 24 hours of your order (Monday through Friday). Items that are out of stock will be backordered. Because shipping charges are calculated on the total order there is no additional charge for back ordered items.

Any items that are customized or special ordered may require additional time to complete the order. We will advise you with an estimated shipping date.

TideandWeather.com, Topsailgiftbasket.com and TopsailTrading.com use UPS and USPS as its carriers. All shipping charges and fees are directly computed by our carriers and passes on to you with no mark-up.

During the checkout process you will enter your name and address and establish a customer account so that shipping charges can be computed. You will have the opportunity to view the exact charge for Shipping and Handling prior to inputting any credit card information. If everything meets to your satisfaction, completion of the transaction is just a few clicks away!

You may return most items sold within 30 days of delivery for a full refund.

NOTE: Shipping and handling charges are not refundable.

You will receive 100 percent of the purchase price under the following conditions.

Returned items must:

    -   Be undamaged and in like-new condition (if defective you must

        consult the manufacturer for warrantee support)

    -   Include all original packaging materials and manuals

    -   If original packaging is damaged a restocking fee of 50% will be

        applied (nobody likes to purchase an opened box!!)

    -   Include the sales receipt or copy of your internet order

    -   Returned within 30 days

To return an item, please follow these three simple steps to assure quick processing and to receive full credit, less shipping and handling for the item you are returning.

1) Email us at info@topsailtrading.com or call 1-910-328-1905 and include: your order number, the name of the item, date purchased, and your name, address and phone number. We need this information to verify your order. Please indicate your preference for an exchange or refund.

2) A customer service representative will respond to your email within 48 to 72 hours or if communicating by phone will immediately issue you a return merchandise authorization number once your order is verified. Please write the RMA number on the packing slip inside your package and on the outside of your package. Please note that we cannot process returns without an RMA number.

3) Return the unused item and all of its original packaging. We recommend that you ship the item insured as we cannot offer refunds for packages that become lost en route. For security reasons, please do not write "jewelry" on the outside of the package. Send to:

Once your authorized return is received it will be reviewed by our Quality Assurance department. Your purchase will be refunded back to your credit card or an exchange will be shipped within seven days.

All unauthorized or improperly packaged returns will be returned to sender. Please note that items that show signs of wear or have been resized, engraved, altered, or damaged in any way cannot be accepted for return.

Refused Packages:
Please do not place an order with us if you anticipate that you may refuse the package upon delivery. In all cases of refused packages, shipping and handling services will not be refunded. If you place an order with us, and refuse the package upon delivery, all further orders placed by you will be immediately cancelled; no exceptions.

Special Orders:
All special order items (jewelry, engraving, special sizes of clothing, general merchandise, etc) are never refundable.
